Los niños de entre 6 y 16 años tienen la obligación de ir al cole. Nuestra ley educativa establece que es obligatoria la escolarización en un centro homologado por el estado, en este tramo de edad. Para niños de infantil de 3, 4 y 5 años, por tanto, no existe esta obligación.
Si hay un número de faltas sin justificar elevado se activa el protocolo de absentismo escolar para comprobar qué está pasando y se abre un expediente. Según la comunidad o el municipio, el número de faltas y el trámite varía.
Primero, será la dirección del centro quien se ponga en contacto con la familia; después se pondrá en conocimiento de servicios sociales o la comisión de absentismo, según el municipio; por último, pasa a manos del fiscal de menores.
Si no se corrige, la falta de asistencia puede ser considerada una situación de riesgo o incluso de desamparo. No obstante, tanto jueces como fiscales prefieren que la falta de escolarización se resuelva por otras vías siendo la vía penal el último recurso solo para situaciones excepcionales.
